At least $2.6 million ratepayer funds being spent because Council refuses to determine mana whenua. Horowhenua District Council has committed at least $1.4 million ratepayer funding to Te Rūnanga o Raukawa and $814,500 to Muaūpoko Tribal Authority and the Muaūpoko Lands Trust in two separate agreements over Levin’s Waste Water Treatment Plant called The Pot. The agreements, worth a combined minimum total of $2.6 million, were signed by all parties prior to a decision by Manawatu Whanganui Regional Council hearing commissioners on June 2, 2020 to grant the Council a 25 year resource consent to continue storing and discharging treated waste water to The Pot, situated on ecologically and culturally important sand dunes about 4 kilometres west of Levin. In both agreements the Council says it, “takes no position in relation to who holds mana whenua, customary interests and rights, and/or rights of iwi/hapu over any area.” An Environment Ministry document titled ‘Guidelines for Consulting with Tangata Whenua under the Resource Management Act: An Update on Case Law’ states that although determining who holds mana whenua “can be a controversial issue” that “reasonable steps must be taken to identify the correct tangata whenua group. “It is the third agreement Council’s chief executive David Clapperton has signed with Te Rūnanga o Raukawa without the matter being discussed around the Council table – and the second known agreement signed by Larry Parr who is listed on Council’s webpage as chief executive officer for Te Rūnanga o Raukawa. Mr Clapperton also signed lucrative financial agreements with Te Rūnanga o Raukawa over Foxton’s Waste Water Treatment Plant and the Levin Landfill. The latest agreement was signed on behalf of Ngati Raukawa hapu including, “Ngati Kikopiri (Ngati Huia), Ngati Hikitanga and Ngati Pareraukawa. ”Ngati Raukawa hapu parties to the agreement include Pataka Moore, David Moore, Rachael Selby, Ngatokowaru Marae Committee and Ngati Kikopiri Mori Marae Committee Society in association with the Kikopiri Marae Reservation Trustees. Te Rūnanga o Raukawa, Muaūpoko Tribal Authority and Muaūpoko Lands Trust all agreed to:

1 Inform the regional council within 24 hours of signing the agreement, signed by Te Rūnanga o Raukawa on 5 March and MuaUpoko Tribal Authority on 16 April, “that their position on the Resource Consents have changed and they no longer oppose a 25-year term.”

2 Inform hearing commissioners deciding The Pot application the agreement entered into with the Council responds to, “their concerns, in particular kaitiakitanga, whanaungatanga, manaakitanga and rangatiratanga.”

3 Support the Council in, “any further matters before the hearing commissioners or any appeals” including appeals by the Council if The Pot consent was refused or conditions were imposed which limited or negated the agreement.

4 “Not participate in any way (including supporting any other party) in any process relating to the resource consents being granted, including before the hearing commissioners.”

5 “Not take or be involved in any other proceedings against” the Council or “make complaints against” the Council, “in relation to the discharges at The Pot.”

6 Assist the Council, “to talk with other submitters to try and resolve issues before the hearing commissioners or on any appeal in a manner that achieves the outcomes of this Agreement.”

7 “Work together to identify, assess and, if appropriate, assist consenting potential new areas for irrigation of treated wastewater from the LWWTP on the ‘Tucker Block’ land adjacent to The Pot” owned by the Council.The Council also committed to work with MTA to negotiate and sign a Memorandum of Partnership, “as soon as reasonably practicable, but no later than 3 months from the commencement of this Agreement.”

A contact in the manufacturing industry tells me :

“The way I read this, (the attached OIA response), the consent has only been live for a few weeks so any toxic bait previously made and the air consequently discharged (presumably via the front roller door) was in breach of the RMA.”

This means that all of the baits made for the Hope and Cascade Valleys, Fiordland, aerial 1080 drop last year for DoC’s ‘Battering the Birds’ programme and all of the Pindone rabbit baits were made with the front roller door used as an air extractor!

I am told that the adequacy of a single bag filter system (which is sure to fail at some point) is seriously questionable, as is its failure warning system, (which is based on pressure variations inside and outside). A particle sensor with alarm and auto shut-down might give the neighbours more comfort!!

PCR Ltd, 8 Centrum Lane, Rolleston, got consent to manufacture 1080 baits in mid-2018. The factory is surrounded by businesses. Could the workers in those businesses have been affected by toxic 1080 poison dust coming out of the roller door? It is most certainly not in an isolated area.

Now we hear that a PCR Ltd worker had an accident in a warehouse in Bromley “processing chemicals that were going to be delivered to the main PCR office in Rolleston”. This happened on 28 May and is only just released in the news tonight, two weeks later. The last I heard the poor man was in a coma. Did the warehouse in Bromley have consents to be processing poisons?!!!

On ‘Operation Ban 1080’, Dave Burrows has stated publicly “This is KiwiCare” property owned by Matthew O’Brien. It is not licensed to carry out any poison work at Bromley. He also owns 51% of PCR Ltd at Rolleston. Let us hope this does not become another coverup job!!” See photo of OBrien attached.

PCR Ltd is operated by Kiwi Care Corporation. It is 49% owned by the West Coast Regional Council, and 51% owned by Pest Control Investors Ltd ( O’Brien?), and is operated by KiwiCare Corporation.

Note we don’t condone or advocate violence, & unlike those who support the use of 1080 poison we do not support cruelty to animals. Note it can take up to two days for animals to die an agonizing death from 1080. Now that is violence.

 

The peaceful hikoi against 1080 is met with a 40-50 strong Police presence & a lawyer giving legal advice says she was assaulted

“A large group of anti-1080 protesters were partaking in a hikoi to Parliament when they were met with an “enormous police presence”, according to lawyer Sue Grey who was among those protesting.”

Sue said she was later assaulted whilst giving legal advice to arrestees.

“Ms Grey estimated there were between 40 and 50 police officers blocking the road from Onepoto Domain as the group were preparing to cross the Harbour Bridge.

“The whole thing just turned ugly in moments from the police conduct,” she said. “It was just unbelievable; it was like walking into a nightmare. They were extremely firm and in some cases physically assaulting people. It was a very frightening scene that I’ve never come across before.” ”  newshub.co.nz

Remember folk, your government (that is how a corporation & owns the factory that produces 1080) has allowed the rules to be changed to allow the dropping of 1080 into your waterways. I mention corporation because a corporation* cannot & does not  place the interests of you the people above those of the corporation.

It was landing there anyway prior to this change (see here also), however it has now been made legal.

This should be concerning you.

The people on the hikoi have noted this change of tack & are saying in effect, ‘enough is enough’. We do not want our whenua, our land and our water, poisoned with impunity. Listen below here to more of that detail around why.

In 2017 the NZ Govt effectively excluded the aerial distribution of poison bait, from the protection of the Resource Management Act – still trust them then with your safety?

Through its new rules the New Zealand Government has effectively excluded the spreading of Compound 1080 – a WHO class A1 eco-toxin – from environmental protection legislation, to increase its company profits … TV-Wild

Matata existing use rights cull one step closer after Bay of Plenty Regional Council decision – another Agenda 21/30 land grab?

Matata landowners have been left in limbo after a proposal to strip existing use rights over safety concerns was accepted by Bay of Plenty Regional Council.

The landmark decision will see 34 houses and sections lose the right to inhabit their property as part of a voluntary retreat. It is believed to be the first time the Resource Management Act has been used in this manner.

Whakatane District Council lobbied Bay of Plenty Regional Council to consider a plan change that will prohibit residential activity in the Awatarariki Fanhead at Matatā after March 2021. The plan change was suggested after $1.2 million was spent investigating how to mitigate safety concerns to residents unsuccessfully.

The plan change will prohibit all residential activity in the affected area.

Impacted residents say they will fight the plan change through legal means.

“We don’t want this to end up in court but when you back people into a corner they fight,” resident spokesman Rick Whalley said.

Is Local Government in New Zealand Corrupt?

This is right on topic and worth a re-visit in light of recent goings on around the country. We as a nation have adopted such a time worn clean green image, it doesn’t occur to many that the reality of the image died long ago, especially with only 40% of our rivers now clean enough to swim in. The clean and green has spilled over long ago into every area of our lives to the extent most Kiwis wouldn’t dream of believing corporations lie to us. Invited over a year ago to speak to a group of senior cits about Smart Meters (aka here as Advanced Meters) my information was greeted in some corners with snickers and whispers. We are a very trusting nation, particularly that generation. That was great three and four decades ago. It isn’t any more. If you are that trusting now you are fair game and seen as simply a sucker. I watch with angst as I see it played out before me … the elderly treated as cash cows by enterprising and unscrupulous business people, and particularly real estate agents. If you’re snickering now please go and watch The Corporation documentary (halfway down the ‘Corporations’ page). That will make you stop. Not to get off topic here (I could say much more but I won’t) … our District Councils have come under much scrutiny of late with many particularly savvy people holding them to the lip service they tend to pay on their websites. Listen to the story of the man in Rodney who exposed the corruption in his District Council. He lost his home and business. Certain ones will deal to those who rock the boat it seems.

With three officers from Auckland Council CCO – Auckland Transport – now set to go on trial for bribery it is a convenient opportunity to raise the issue of corruption in local authorities.

Most ordinary citizens have no idea that corruption is rife. But there are varying types of corrupt behaviour and unless one is familiar with the law they can be overlooked.

Two of the most common forms of corruption occur so often you think it’s normal.

These two particular forms of corruption do not result in personal gain – such as back pocketing cash. But they do result in breaking the law, and they happen daily.

The first is ‘malfeasance’ and the second is ‘misfeasance’.

Both are the abuse of authority – or the position of authority.

These generally occur by breaking the rule of law. In NZ the laws that generally govern Local Government are the LGA (Local Government Act) and the RMA (Resource Management Act). Some other laws like the Public Works Act are part and parcel as well.

Breaking the law for ordinary citizens results in penalties. If caught it can do the same for those in local government but nobody is policing them so nothing happens.

Water Wars in ‘Clean Green’ NZ?

Most people who subscribe to truth sites similar to this one will be aware that water is becoming the new ‘gold’. This was ‘prophesied’ in a sense by Maude Barlow and Tony Clarke in their book called ‘Blue Gold the Battle Against Corporate Theft of the World’s Water’ (2001), a very interesting and informative read. (The documentary of the same name is on YouTube.)

Here in NZ recent news items have questioned ‘who owns our water?’  ‘Nobody’, says the current PM John Key …  and yet a Hawkes Bay bottling plant (Chinese owned) has been sold pretty cheap rights to bottle and export 900 million liters per year. While locals who wish to water their orchards are required to pay for it.  Read the explanations for this and to the average citizen they sound like gobbledy gook … citing the Resource Management Act (RMA) and spun in legal rhetoric most of us can’t understand. This is the way of big business.

NZ’s Maori King, King Tuheitia says Maori “have always owned the water.”  In August 2012, the Waitangi Tribunal found that Māori still have residual proprietary rights in water and the Crown would breach the principles of the Treaty of Waitangi if it went ahead with the sale of State owned power company share sales. Maori customary title, according to the 2003 “Ngati Apa” decision of the Court of Appeal, must be lawfully extinguished before it can be regarded as ceasing to exist. Customary rights, although not ownership in a Lockean sense, says the NZ Herald, still represent more than the relegation of Maori to being non-owners of non-ownable water. Indeed, when acquiring the land for the Crown, the Queen solemnly agreed for Maori to retain “full exclusive and undisturbed possession of their Lands and Estates Forests Fisheries and other properties which they may collectively or individually possess…”

Still it appears perfectly legal in the case of Hawke’s Bay, for the local council there to sell an offshore corporation the rights to extract large quantities, even though, as John Key argues, nobody owns it.

For the purposes of introduction here, water and one’s right to it is becoming somewhat complicated.  There are places on the planet where the powers that be have integrated into law the prohibition of collecting it for personal consumption. As insane as this may sound it is factually true. As always, follow the money trail.

Corporations are seeking to privatise our water commons for a profit (and yes it was always considered one’s right to water is sacrosanct). Exemplifying their typical avarice for more and more profits, they seek to gobble up all the water resources and rights to them it seems, and sell them back to us at exorbitant prices.

The company Nestlé is guilty of this. Whilst its chairman Peter Brabeck-Letmathe  proclaims water is a human right, the company is busily selling off drought-stricken California’s water. Nestle owns 70% of the world’s bottled water brands.

This is the way of corporations. They are seldom for the people and always for their shareholders. Separate entities with legal personhood they manage to do just about anything their shareholders wish for them to do whilst escaping accountability for any damage they incur.

A few years back in Cochabamba Bolivia, a large corporation had privatised the water and was charging around half the income of the poor to buy it off them. So oppressive did this become it ended up with riots and even loss of life to oust the corporation and return to the previous status quo.  If there is anything you should learn on this site it is that corporations are not generally kindly companies that wish to help people. (Please watch ‘The Corporation’ movie).  Any intimation from them that they wish you well is generally just rhetoric to appease you or persuade you you to buy.  This attack on the rights of people to drink the essence of life, (and it is well established that water is essential to life itself) is a huge attack on our ultimate freedoms. Fifty years ago this line of thinking would be unheard of … unthinkable. As I’ve pointed out often here, fifty years ago most households had their own water tanks to collect rainwater. That was standard practice. And yet, today it is being put to us as being right and proper that we should not be collecting it at all. We have been seriously duped by little increments that corporations can, but not we the people. Lest I be misunderstood here, I am not against water conservation. I simply believe, like most ordinary folks, that water should not be virtually given to corporations to profiteer with, at the expense of locals who need it for day to day survival.

Welcome then to the water wars. And I’ve not even touched on water pollution and our health. In the meantime, be sure to stand up for water rights wherever they are being quietly, or not so quietly, whittled away. Next we will be charged for the air we breathe. 12 March 2015     I attended the Marton Community Committee meeting last night where Mayor Andy Watson was present, and raised the historic issue of there having been both missing and non-compliant leachate reports. This was not regarded as an unusual occurrence and in the bigger picture, neither it seems is the state of our water ways (whatever that may be given the Chronicle report prior to Christmas indicated that was difficult to guage , given reports were missing). I did express the irony of this given Horizons was mandated with protecting our environment, clearly set out in their website banner.

As regards the in-stream biota survey and the fact one had not been done since 2002, it remains unclear as to whether there will be another done to assess the health of our local stream, in spite of the fact that the consent required one every three years. I was advised by Mayor Andy to notify himself, the CEO and the Councillors by mail to further this matter.

To date, as at 20th May 2015 nobody has acknowledged my email. Ironic isn’t it that one is encouraged to communicate on’es concerns on a matter to the council via its community committee, only to be told at that meeting, to email the matter to the very persons one is speaking to at that meeting about the concern.
